The industry has made significant progress with respect to lien litigation through legislative change and case law. Yet lien issues continue to be an industry wide problem plaguing employers and insurers alike. Liens are costly to litigate and prolong the life of the claim. However, there are effective claims management techniques that can help reduce the pitfalls and frustrations encountered when handling lien litigation. In this presentation we will discuss some of these techniques with the hope of providing you with a better understanding of the nuances in lien negotiations, lien settlements and lien litigation.
